Terms of Service

1. Acceptance of Terms

By accessing or using BunnyPost ("the Service"), operated by Bunny Agency ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including team members, administrators, and viewers.

2. Description of Service

BunnyPost is a social media scheduling and management platform that enables users to:

  • Connect and manage Instagram Business and Creator accounts
  • Schedule, create, and publish posts (images, carousels, reels, and stories)
  • Auto-post first comments, CTAs, and hashtag comments
  • Set up automated posting workflows with media from Google Drive
  • Manage media libraries, caption templates, and hashtag sets
  • View analytics and engagement metrics for connected accounts
  • Collaborate with team members under role-based access control

3. Account Registration

To use BunnyPost, you must:

  • Be at least 16 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Connected Social Media Accounts

By connecting your Instagram or other social media accounts to BunnyPost, you:

  • Authorize us to access your account via official APIs to provide the Service
  • Confirm that you have the authority to connect and manage these accounts
  • Acknowledge that we will publish content on your behalf as you schedule it
  • Understand that we store encrypted access tokens to maintain your connection
  • Can disconnect your accounts at any time through the Settings page

We access your social media accounts only through official, authorized APIs (Meta Graph API, Instagram API) and comply with their respective platform policies and terms of service.

5. Acceptable Use

You agree not to use BunnyPost to:

  • Violate any applicable law, regulation, or third-party rights
  • Post spam, misleading, or deceptive content
  • Harass, bully, or threaten other users or individuals
  • Distribute malware, viruses, or other harmful software
  • Infringe on intellectual property rights of others
  • Circumvent rate limits, API restrictions, or platform guidelines
  • Attempt to gain unauthorized access to other accounts or systems
  • Use the Service for any illegal, fraudulent, or unauthorized purpose
  • Post content that violates Instagram's Community Guidelines or Terms of Use
  • Create fake engagement, use bots, or engage in artificial manipulation

6. Content Ownership and Responsibility

6.1 Your Content

You retain all ownership rights to the content you create, upload, or publish through BunnyPost, including captions, images, videos, and templates. By uploading content to BunnyPost, you grant us a limited, non-exclusive license to store, process, and transmit that content solely for the purpose of providing the Service.

6.2 Content Responsibility

You are solely responsible for all content published through your connected accounts via BunnyPost, including scheduled posts, auto-comments, and workflow-generated content. We do not review, approve, or endorse any content published through the Service.

6.3 Content Removal

We reserve the right to remove content or disable features if we believe they violate these Terms, applicable laws, or third-party platform policies.

7. Team Accounts and Roles

BunnyPost supports team-based collaboration with role-based access control:

  • Admin: Full access to all features, settings, and team management
  • Manager: Can manage accounts, posts, workflows, and templates
  • Poster: Can create and schedule posts, manage media
  • Viewer: Read-only access to posts and analytics

Team administrators are responsible for managing team membership and ensuring all team members comply with these Terms.

8. API Usage and Rate Limits

BunnyPost enforces rate limiting to protect your social media accounts and comply with platform API restrictions. You agree to:

  • Not attempt to bypass or circumvent rate limits imposed by the Service
  • Not exceed 200 API calls per hour per connected account
  • Not publish more than 25 posts per 24-hour period per account
  • Accept that posts may be delayed or queued to comply with rate limits

We implement circuit-breaking and automatic backoff to protect your accounts from being flagged or restricted by Instagram.

9. Automated Features

BunnyPost offers automated features including workflows, auto-comments, and scheduled posting. By using these features, you acknowledge that:

  • Automated posts are published according to your configured schedule
  • First and second comments are posted with configurable delays after publishing
  • Workflows automatically select and publish media from your connected sources
  • You are responsible for reviewing and configuring automation settings
  • Automated actions count toward API rate limits and platform restrictions
  • We are not liable for content published through misconfigured automations

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Posts will always be published at the exact scheduled time
  • Third-party APIs (Instagram, Google) will remain available or unchanged
  • Analytics data will be perfectly accurate or real-time
  • The Service will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUNNY AGENCY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or content
  • Social media account restrictions, suspensions, or bans
  • Failed or delayed post publications
  • Unauthorized access to your account due to compromised credentials
  • Changes or disruptions to third-party APIs or platform policies

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bunny Agency and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Content you publish through the Service
  • Your violation of these Terms
  • Your violation of any third-party rights or platform policies

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time through the Settings page or by contacting us.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, except where retention is required by law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying you via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
